Is my vehicle a \u201ctotal loss\u201d?<\/strong><\/p><p>In Oregon, generally a car is deemed a \u201ctotal loss\u201d when it takes more than 70-80% of car\u2019s value to fix it. This can vary depending on the insurance company. When your vehicle falls into this category, then the following section out of the Oregon Administrative Rules is an excellent overview of what to expect:<\/p><p>OAR 836-080-0240 (Exhibit 1):<\/p><p>Vehicle Total Loss Notice: Your vehicle has been declared a total loss. This notice is required by Oregon law and explains your rights and a typical claims process.<\/p><p><strong>What is a \u201ctotal loss\u201d?<\/strong><\/p><p>The Oregon Vehicle Code defines a total loss as a vehicle:<br \/>(1) that is declared a total loss by an insurer that is obligated to cover the loss or<br \/>(2) that the insurer takes possession of or title to.<\/p><p>Usually, this is because the cost of repair makes repairing the vehicle impractical.<\/p><h2><strong>What are your choices?<\/strong><\/h2><p>If the insurer keeps your vehicle, the insurer\u2019s offer will be based on its determination of your vehicle\u2019s actual cash value immediately before the loss (its pre-loss value).<\/p><p>If you keep your vehicle, the insurer\u2019s offer will be based on its determination of your vehicle\u2019s actual cash value immediately before the loss, reduced by your vehicle\u2019s salvage value (the amount that your damaged vehicle is worth).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t<div class=\"elementor-element elementor-element-5268c115 e-con-full e-flex elementor-invisible e-con e-parent\" data-id=\"5268c115\" data-element_type=\"container\" data-settings=\"{&quot;animation&quot;:&quot;fadeIn&quot;}\">\n\t\t\t\t<div class=\"elementor-element elementor-element-51bd8302 elementor-widget elementor-widget-heading\" data-id=\"51bd8302\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">HOW IS THE VALUE OF YOUR VEHICLE AND YOUR INSURANCE CLAIM PAYMENT DETERMINED?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1548ce9 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"1548ce9\" data-element_type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-48b5b23e elementor-widget elementor-widget-text-editor\" data-id=\"48b5b23e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"p1\" style=\"margin-top: -9px;\">\u00a0<\/p><p>Insurers may use independent vehicle evaluation companies, vehicle appraisers, guidebooks, or quotes from dealers to establish your vehicle\u2019s value.<\/p><p>\u00a0<\/p><p>Insurers also consider your vehicle year; make; model; mileage; equipment; options; geographic location; recent upgrades, such as a rebuilt engine or new transmission, etc; and the condition of your vehicle\u2019s body, paint, tires, glass, interior, mechanical condition, and prior unrelated damage as this information may affect the value of your vehicle.<\/p><p>\u00a0<\/p><p>Insurers use this information to compare your vehicle with similar vehicles recently sold or offered for sale in your local market area, in order to determine your vehicle\u2019s pre-loss value.<\/p><p>\u00a0<\/p><p>The insurer puts this information into an evaluation report and must provide you with a copy of this report.<\/p><p>\u00a0<\/p><p>Contact your claims adjuster if you find errors in this report.<\/p><p>\u00a0<\/p><p>If your claim is with your insurer, your policy\u2019s deductible will be deducted from the claim payment. If your claim is filed with the other driver\u2019s insurer, the claim payment may be reduced by an amount that reflects your percentage of fault for the accident and\/or if the other driver\u2019s insurance policy limits are not large enough to pay for the value of your vehicle.<\/p><p>\u00a0<\/p><p>If your claim is with your insurer, the insurer may elect to offer a replacement vehicle that is at least comparable to the insured vehicle.<\/p><h3>\u00a0<\/h3><h3><strong>What if you disagree with the insurer on the value of your vehicle?<\/strong><\/h3><p>You do not have to accept the insurer\u2019s offer.<\/p><p>\u00a0<\/p><p>You can continue to negotiate with the insurer.<\/p><p>\u00a0<\/p><p>Show the insurer evidence of a higher value, such as guidebooks, quotes from dealers, newspaper ads or online ads for similar vehicles in your area.<\/p><p>\u00a0<\/p><p>Adjust for differences in factors such as mileage, vehicle condition, and accessories.<\/p><p>\u00a0<\/p><p>If you and the insurer cannot reach a settlement agreement, the insurer is obligated to pay you the amount of their offer that is not in dispute when you agree to complete the necessary documents to transfer vehicle ownership to the insurer, and allow the insurer to take possession of your vehicle.<\/p><p>\u00a0<\/p><p>This provision applies to all new policyholders on or after January 1, 2010 and to current policyholders upon the first renewal of their policy that occurs on or after January 1, 2010.<\/p><p>\u00a0<\/p><p>For example, if the insurer offers you $1,000 for your vehicle but you believe it is worth $2,000, the insurer must pay you the amount not in dispute, or $1,000 when you have agreed to complete the necessary documents to transfer vehicle ownership to the insurer.<\/p><p>\u00a0<\/p><p>After 14 calendar days, the insurer may sell the vehicle. The insurer is not obligated to pay you the amount not in dispute if you decide to keep your damaged vehicle.<\/p><p>\u00a0<\/p><p>Payment of the amount not in dispute does not mean your claim is settled. You can continue to negotiate with the insurer to seek an additional payment.<\/p><p>\u00a0<\/p><p>If your claim is against the other driver\u2019s insurer and you disagree with that insurer\u2019s offer, you may be able to make a collision claim with your insurer.<\/p><p>\u00a0<\/p><p>If your claim is with your insurer, and you notify the insurer that you cannot purchase a vehicle for the amount offered, you may locate a comparable vehicle yourself and, if the insurer agrees, the insurer may either buy the vehicle for you or pay you the difference between the amount offered and the cost of the comparable vehicle you found.<\/p><p>\u00a0<\/p><p>If your claim is with your insurer, you may have the right to an appraisal if your policy includes an appraisal provision.<\/p><p>\u00a0<\/p><p>Your insurer must reimburse your reasonable appraisal costs if the final appraised value is greater than the insurer\u2019s last offer.<\/p><p>\u00a0<\/p><p>This provision applies to all new policyholders on or after January 1, 2010 and to current policyholders upon the first renewal of their policy that occurs on or after January 1, 2010.<\/p><p>\u00a0<\/p><p>Ask your claims adjuster or the Insurance Division for more information.<\/p><p>\u00a0<\/p><p>Property damage after an auto accident \u2013 for vehicles that are \u201cnot\u201d a total loss; auto collision repairs and \u201cdiminished value\u201d claims:<\/p><p>\u00a0<\/p><p>You\u2019re entitled to get your car back in pre-accident condition after the repairs are done. If you had tinted windows before the crash, you get tinted window replacements in the repairs, et cetera. Further, you don\u2019t have to accept a vehicle back that is dangerous to drive; while it can be an uphill climb, sometimes a car is a \u201ctotal loss\u201d even after it\u2019s been repaired. That can be due to the frame being bent, or other conditions that make it an unsafe vehicle. Most body shops check for frame damage, and if the collision was significant you may want to seek for it to be deemed a total loss.<\/p><p>\u00a0<\/p><p>Once repairs are done and you\u2019ve accepted the vehicle back, Oregon Law permits you to get what\u2019s called \u201cDiminished Value\u201d (aka, \u201cDiminution in Value\u201d) of your vehicle. That is the difference between what your car was worth before the wreck, and what it\u2019s worth afterwards. This is only fair, since if you tried to sell the car now, you\u2019d take a hit on the price once you tell the buyer it\u2019s been in a crash.<\/p><p>\u00a0<\/p><p>You may not be able to sell it at all now. This value can be tough to establish, but often a car dealership can estimate how much less they\u2019d have to sell a car like yours that\u2019s been damaged.<\/p><p>\u00a0<\/p><p>The system is lopsided in favor of insurance companies.
